I was a tenant residing at No. 10, 1st floor, “Saraswathy “building, Hemant Nagar – 2nd Cross, Near HEA College, Chinnappanahalli, Marathahalli Post, Bangalore – 560037. We went to our home [Kerala] on 18th June 2020 and one month later we decided to vacate our house in Bangalore. My husband called house owner on 20th july 2020 and informed about our plan to vacate home in Bangalore. The House owner informed us about the notice period clause in rental agreement and we agreed for the same. As soon as we told about our notice period ending date as 20th Aug 2020, house owner started behaving very badly and he used abusive words on us. He forced us to vacate immediately so that he can accommodate a new tenant. We couldn’t find alternative way to shift our baggage within short time so we finally decided to transfer to Kerala itself because of him. We arranged packers and movers and told our friends to take care of everything. We vacated our home with the help of our friends and packers and movers on 25th July 2020 itself because we worried about out security deposit of 1 lakh. On the day of vacating our house, house owner came to our home and has thrown all the boxes from shelf to floor and told to clean everything. He also behaved very badly with our friends and packers and movers. He was not at all cooperating with them and he was creating trouble to packers and movers and they struggled a lot to load the things to vehicle. Our house owner was not ready to give space to packers and movers to park their vehicle in front of home which made them to unload the things to their vehicle at a very far place from our home. Packers and movers got angry on us because of the bad behavior of house owner and they didn't clean the home and went.
After the packers and movers left from our home, the house owner called us immediately and told us to clean the home. We told them that we are not in Bangalore and how can we do it. Finally they told they will deduct cleaning charges from deposit and we agreed for the same.
On next day morning, ie; on 21st July, we got a call from house owner to clean our rented home. They are not even cared about the current lockdown situation. We are not in Bangalore and still they insisted us to do so. Then, we arranged a person [who use to come to our home to supply water] to clean home and he did it very well. House owner behaved indifferently with him as well and he complained about house owner to us.
Finally, after everything is done, we asked for security deposit and he told us that he will return only on 20th August. We asked him about the deductions and he told he will take 1 month rent [18000/-] for notice period and 1 month rent[18000/-] for painting and cleaning charges. He made us to vacate immediately and we struggled a lot because of him. Then why to give 1 month extra rent for notice period. Also, we maintained our house in good condition and it didn't need repainting at all. Also, we only arranged a person to clean rented home. Then why we need to pay 1 month rent as painting and cleaning charges? House owner was not even listening to our points and he said as per agreement, he will take. He was not even giving us time to negotiate. Is this the way to behave with a tenant?
Since, our deposit was with him, we didn’t argue much. Finally on 21st August 2020, he transferred 46k to my account. We called him to talk about deductions in detail and he didn't attend our call. We tried many times and we couldn’t connect to him. He blocked our contact details. Please help us on this issue. Most of the house owners in Bangalore are forcing to pay huge security deposit and tenants have no other option. At the end, they will deduct a bulk amount in terms of notice period, painting charge etc. It is really painful to lose our money.
SUMMARY
We stayed for 1yr 7 months and we maintained our house very well. Our rent is 18k and deposit we paid is 1lakh.
Deductions from owner side:
1. 18k – 1 month rent[July] that is fine .
2. 18k – 1 month notice period[ We agreed for one month notice period upto 20th August 2020 and he behaved very badly with us and insisted us to vacate immediately. After doing all these, he deducted 18k. He should have deducted only 12k since notice ends on 20th August]. Also, why to pay 12k if a person is forcing us to vacate during lockdown time after creating so much troubles to us. Because of him, we paid 16500 to packers and movers to transport our luggage to kerala.
3. 18k – painting and cleaning charge. [We only arranged a person to clean home and paid him cleaning charges. Also, the house doesn’t need any repainting at all. So how can he deduct 18k for painting and cleaning charges?
Also, he posted advertisement in no broker on 30th July 2020, for finding a new tenant with immediate possession. How can he do that? Since our notice period ends only on 20th August. This clearly indicates that he didn't repaint his home.

PLEASE HELP US ON THIS ISSUE. SINCE WE ARE NOT IN BANGALORE, WE CANNOT DO ANYTHING FROM OUR SIDE. GOING TO COURT IS ALSO NOT POSSIBLE. THERE SHOULD BE SOME AUTHORITY TO HELP TENANTS SINCE THEY LACK BARGAINING POWER WITH LANDLORD. |
