NEW Sub Dated 02:06:2025 : Unauthorized construction of a six-floor apartment without building plan approval, without providing the required setback, and without obtaining permission from the concerned departments—causing significant disturbance to the neighboring residents
He has encroached our land about 2x40 feet on the north side and 60x5 feet on the other side. Action may please be initiated against sri. Ashwatha reddy as per Bruhat Bengaluru Mahanagara Palike(BBMP) Acts, Rules & Building Bylaws to reduce the building floors & provide set back. Site area:set back area: floor area of his house may please be checked and compared. If any body questions, he threatens them & say “ a case under section 107 “will be made filed on Sr.citizen questioners
Ref: My letter enclosing snap shot of complaint dt.18.11.2024 to email id comm@bbmp.gov.in and Your officer visited the spot on that day but still no further action has been initiated from BBMP’s side.
With reference to the above subject, I am Sri.A.S.Maruthi prakash, informed your office on 18.11.2024, so far no action has been initiated. We have One 30x40 site on the north side of the property of sri.Ashwath Reddy B. who is unauthorizedly constructing a Residential Apartment without any plan approval and also encroaching my land towards the north side by 2x40 feet and other side of his site by 60x5 feet. His site and built up area may please be measured to check the ratio of actual site area: built up area: set back area & set back as per bylaws .
This measurement does not tally the bbmp bylaws. This sort of unethical act may please be set right and he should not be granted building licence, building plan should not be considered for approval because he has encroached the floor area more than his actual site area. He should not be issued a completion certificate, and not be issued occupancy certificate, also he should not be issued “e khata“for his residential apartment( now-constructing). If e katha is issued, it happens to be against the rules i.e built up area and set back exceeds the actual area of his site.
There are many apartments like sai serenity layout apartments at K.R.Puram for which BBMP have raised objection and issued public notice with regard to the guidelines of court i.e to be followed by builder.” That many unauthorized multi-stored residential complexes were constructed without any plan approvals from the BBMP without providing proper setback areas, parking spaces, drainage systems, sewage treatment plants and rainwater harvesting systems”. The BBMP has already sent notices under the BBMP Act 2020 to the builders/owners of the high-rise buildings. Hence, this person i.e. sri.Ashwath reddy may also be issued notice for Unauthorized construction of residential apartment by encroaching 2x40 feet towards north side and 60x5 feet towards other side, he may also be checked as he has obtained or not the permissions from Pollution control Board, fire and safety department. While he has not provided set back, if fire accident,any disaster occurs, where is the set back open place for fire and safety department to do the rescue operation?. As per BESCOM recent circular published in prajavani , States that BBMP/Panchayat Raj departments forward the particulars of Unauthorized constructions to the BESCOM, then BESCOM will stop/withdraw the electrical connections to such unauthorized apartments/buildings.The same procedure to be followed by BWSSB also. Hence, it is requested to forward the particulars of this Aswath reddy’s unauthorized constructions of residential apartment, to BESCOM & BWSSB to initiate further action. As he is working in a construction company, he is well aware of the “law of the land”. Hence, there is no excuse in this case.
He has installed a generator which is making a lot of noise. This place is not fit for constructing residential apartments, because wide roads and other amenities are not there, also all residents are having small individual houses for leading silence and peaceful life. Hence, it is requested that a stern action may be initiated to reduce the number of floors & buildings be redressed to provide set back area. Also
give back encroached land of 2x40 at the north side and 60x5 feet towards the other side of his site. If BBMP has not taken suitable action to vacate the encroached land and set back provisions are not maintained, it will be construed that your silence confirms giving permission for me and all citizens to construct buildings/apartments unauthorizedly in any manner convenient to them
