I wish to formally bring to your attention several issues arising from the neighbouring property’s construction activities, which have caused direct damage, obstruction, and safety concerns for our home. Despite multiple assurances from the neighbours, the problems remain unresolved.
1. Non?restoration of our property despite prior agreement
During the construction of their house, the neighbours had initially agreed to restore our property to its original condition. In good faith, and maintaining good neighbourly conduct, I provided them with water, electricity, and even space for painting and welding work multiple times.
However, our property has not been restored—not painted, repaired, or returned to its original state as assured.
2. Third?floor iron sheet blocking air/light and diverting water onto our home
After completing their construction, they installed an iron sheet on the third floor which blocks air and natural light to our home.
The sheet also diverts rainwater directly onto our property, causing repeated water flow issues.
When questioned, they agreed to remove it, but it remains intentionally left in place to date.
3. Grill cutting and non-restoration
For their plastering work, they cut the entire grill of two floors of our house into multiple pieces.
Even after four months, the grills have not been painted, remain rusted, and have not been restored.
They had clearly agreed to restore everything within 15 days of completing work on that side, but no action has been taken.
4. Chamber (Drainage outlet) damage
The chamber outlet on our side was damaged during their construction using a JCB.
They repaired it once, but the same problem reoccurred, indicating poor workmanship.
Finally, I had to repair it again at my own expense.
5. Cement water leakage into our sump
During the initial moulding work, no tarpaulin was placed on our side.
As a result, cement-water mixture entered our water sump, contaminating it. This still has not been cleaned.
Additional cement debris also remains stuck on the sump cap.
6. Cleaning not done; flooring damaged
Our premises remain unclean, with cement still lying on the granite flooring.
They had agreed to polish the floor after their work, but this has not been done.
7. Structural rod cut without permission (trespass and negligence)
One of the mould column iron rods belonging to our structure was cut without our permission.
This is an act of negligence and constitutes trespassing, weakening our structure.
8. Second-floor staircase area left incomplete
The area near the second?floor stairs still has unfinished plastering and exposed wooden mould blocks.
Despite repeated reminders, the open gap has not been closed.
They themselves acknowledged that insects may enter and agreed to fix it, but nothing has been done.
9. Front elevation damage with cement marks
Our front elevation is now scratched, stained with cement marks, and damaged.
I had specifically instructed them to use tarpaulin while working.
They assured me that everything would be restored, but the current condition is not at all like the original.
10. Wall plastering delay and water seepage
Their side wall was demolished (2×4 ft) and re?plastered after six months.
If they could complete plastering on the back side of their house properly, it is unclear why our side, which is a very small area, remains incomplete.
Meanwhile, the wall remains wet, causing ongoing damage.
